JAKARTA, KOMPAS.com – Asosiasi Persatuan Pusat Belanja Indonesia (APPBI) DKI Jakarta meminta Pemprov DKI meninjau kembali aturan sanksi pencabutan izin pengelola pusat perbelanjaan apabila ditemukan tenant yang tetap memakai kantong plastik sekali pakai.
“Masalah sanksi perlu ditinjau kembali dan tidak disasarkan kepada pusat belanja. Padahal pengelola seharusnya dijadikan mitra kerja bersama Dinas lingkungan hidup untuk membantu mengawasi para tenant,” kata Ketua APPBI DKI Jakarta Ellen Hidayat dalam keterangannya, Kamis (2/7/2020).

Menurut Ellen, sanksi pencabutan izin itu membebani pihak pengelola pusat perbelanjaan dan para pelaku usaha.
Pasalnya, mereka baru mulai memperbaiki kondisi perekonomian usai berhenti beroperasi selama pandemi Covid-19.
“Sanksi yang menyatakan pencabutan izin di saat sedang lesunya daya beli masyarakat menjadi tidak tepat, di mana karyawan juga membutuhkan lapangan pekerjaan,” ungkap Ellen.
Seperti diketahui, Pemprov DKI Jakarta melarang penggunaan kantong plastik sekali pakai pada pusat perbelanjaan, toko swalayan, dan pasar rakyat mulai hari ini, 1 Juli 2020.

Larangan tersebut diatur dalam Peraturan Gubernur Nomor 142 Tahun 2019 tentang Kewajiban Penggunaan Kantong Belanja Ramah Lingkungan pada Pusat Perbelanjaan, Toko Swalayan, dan Pasar Rakyat.
Ada beberapa tahapan sanksi bagi pengelola pusat perbelanjaan apabila ditemukan tenant yang menggunakan kantong plastik sekali pakai, sanksi tersebut mulai dari teguran tertulis, uang paksa, pembekuan izin, dan pencabutan izin.
Untuk sanksi administratif ada tiga kali teguran tertulis yaitu teguran pertama berlaku 14×24 jam atau 14 hari. Terguran kedua berlaku 7×24 jam atau 7 hari. Dan yang terakhir adalah 3x 24 jam atau 3 hari.
Sanksi selanjutnya adalah pembekuan izin yang berlaku jika tidak melaksanakan sanksi administratif uang paksa dalam kurun waktu lima minggu.
Terakhir adalah pencabutan izin yang dilakukan oleh Dinas LH jika pelaku usaha tidak melaksanakan pemenuhan pembayaran uang paksa.
